This Service Agreement is made for the purpose of providing services under the Client's National Disability Insurance Scheme (NDIS) Plan and is made between a Client and/or their Authorised Representative and a Provider.

All whom sign this Agreement understand that this information is provided in the context of the NDIS, which is a scheme that aims to:

  • Support the independence and social and economic participation of people with a disability and;

  • Enable people with a disability to exercise choice and control in the pursuit of their goals and the planning and delivery of their services.

Reframe Careers aims to provide a high-quality service and adheres to the professional standards required of a Careers Practitioners and Rehabilitation Counsellors.

Personal Information

As part of providing the service, Reframe Careers needs to collect and record personal information from you that is relevant to your situation, such as your name, contact information, and other relevant information. This collection of personal information will be a necessary part of the services provided.

Your Privacy

  • Reframe Careers complies with the Privacy Act 1998, NSW Health Records and Information Privacy Act 2002.

  • We will treat personal information in a confidential manner and protect your privacy.

  • We will inform you of our role in teaching and training students and will ask for your consent if it is proposed that a student be involved in your services.

  • Your personal information is collected to be used by your vocational counsellor in the delivery of services  to you. Your personal information will not be disclosed to any third party without expressed, written consent by you.

  • As part of the services, records are kept of your sessions, including minimal information that is important for us to remember when providing ethical and effective care. All personal and sensitive information which is collected will only be used or disclosed in accordance with our Privacy Policy, which you can find here: https://www.reframecareers.com.au  

  • For the enhancement of our services and our staff's professional growth, consultations with supervisors and colleagues may be necessary. These individuals are also bound by confidentiality.

  • A key aspect of working towards your employment-related goals involves collaborating with other clinicians and professionals to support you in achieving success. We will ensure that only relevant information is discussed during these collaborations to assist you effectively. By signing this form, you are giving us permission to collaborate with those coordinating your supports (COS) and providing your services. We will always confirm with you verbally before contacting the providers and you can withdraw this permission at any time by informing us.

Disclosure of personal information

Personal information gathered as part of this service will remain confidential except when:

  • It is subpoenaed by a court; or

  • Failure to disclose the information would place you or another person at serious risk to life,health or safety; or

  • Your prior approval has been obtained to

  • provide a written report to another professional e.g. psychologist; or

  • discuss the material with another person e.g. parent, employer or health provider; or

  • disclose the information in another way; or

  • You would reasonably expect your personal information to be disclosed to another professional and disclosure of your personal information to that third party is for a purpose which is directly related to the primary purpose for which your personal information was collected; or

  • Disclosure is otherwise required or authorised by law.

In some cases, materials or issues from the sessions may be discussed between the career counsellor and their supervising rehabilitation counsellor or career counselling mentor. The purpose of this mentorship and supervision is to provide you with the best service possible.

Confidentiality & Limitations

Copy of Client's NDIS Plan

It is essential for Reframe Careers to have a copy of the My Profile and Goals sections of the NDIS Plan.  This ensures we are working towards your stated Goals, which are required for completing reports for the NDIS.

Schedule of Supports/Services

The NDIS has introduced funding periods and Plan components.

This Schedule of Supports outlines the total plan duration along with the funding allocated to each funding period.

Please note the following:

  • If there are any unused support hours at the end of a funding period, Reframe Careers will automatically roll these over to the next funding period to support continuity of service delivery.

  • If the allocated hours for a funding period are exhausted, services will be paused until the commencement of the next funding period unless we are notified of additional funding being made available within the current funding period.

  • If additional funding is required beyond the agreed total in the current Schedule of Supports, Reframe Careers will communicate this with the Client and provide an amended/updated Service Agreement for their approval. This will also reflect any increase in funding within the funding periods.

ALL funding periods will be below, with the allocation of dollars for Reframe Careers and type of service required.

If there are multiple services required, there will be a new line for each service, so that the dollar allocation is accurate.

If the NDIS Plan is the old lump sum format, the total dollar allocation and type of service required  will be below.

Based on the information you have provided us, we have determined that the Supports above are reasonable and necessary for your specific needs.

If any of the information you have provided us is incorrect or incomplete, please let us know as soon as possible.  Failure to provide us with the most accurate and up to date information may result in us recommending Supports which are not suitable for your individual needs.

Where reasonable, we will give you 24 hours’ notice if we need to change a scheduled appointment

The Support Fees set out above are the amounts payable to us before your NDIS Budget is applied.  
You will be required to pay all or part of the Support Fee if your NDIS Budget does not cover all or part of the Supports.

Any other additional expenses are your responsibility and are not included in the cost of the Supports.

We do not manage your NDIS Budget. We recommend that you confirm how much of the Support Fee your NDIS Budget will cover before receiving the Supports.

Scope of Services

Support to work towards employment-related NDIS Goals via one or more of the following:
Finding and Keeping A Job

  • Employment Related Assessment, Counselling and Advice: Guidance in identifying personal barriers to employment, setting work goals, and developing a tailored plan.

  • Employment Assistance: Support to build skills for work, find and keep a job.

Description of Scope:

  • Assessment, support planning, and delivery of services to prepare for, secure, or retain employment in the open or supported labour markets (including self-employment and micro-enterprises).

  • Assistance in accessing and sustaining education opportunities.

  • Disability-related support for transitioning into new educational or employment settings.

  • Non-Face-to-Face Support: Includes time spent onboarding (including reviewing background reports), report writing, documentation, and communication with Participant, Allied Health Professionals, Support Coordinators, Plan Managers, and other relevant parties.

  • Travel Time: Up to 30 minutes one way at the hourly rate specified in the table below. Return travel (max 30 mins each way) is charged if there are no other appointments for Reframe Careers on that day.

  • Non-labour Provider Travel: $1.00 per kilometre travelled to the Client. Return travel km is charged if there are no other appointments for Reframe Careers on that day.

Support to work towards employment-related NDIS Goals via one or more of the following:

Improved Daily Living

  • Therapeutic Supports: Capacity Building Supports provided by a Rehabilitation Counsellor (member of Australian Society of Rehabilitation Counsellor).

Description of Scope:

  • Assessment, support planning, and delivery of services to prepare for, secure, or retain employment in the open or supported labour markets (including self-employment and micro-enterprises).

  • Assistance in accessing and sustaining education opportunities.

  • Disability-related support for transitioning into new educational or employment settings.

  • Assistance with finding, maintaining or keeping a job.

The Support Fees specified below are:

(i) inclusive of GST (if applicable);

(ii) within the applicable price limits set under the National Disability Insurance Scheme Act 2013 (Cth) and the NDIS Pricing Arrangements and Price Limits; and

(iii) reviewed and increased in accordance with any changes to the NDIS Pricing Arrangements and Price Limits and you will receive prior notice of any increases in the Support Fee.


Conditions:

  • Reframe Careers will increase fees in line with changes to benchmark pricing within the NDIS price guide and support catalogue.

  • Payment will only be charged once actual service has been delivered.

  • A cancellation fee for therapy activities may be charged if notice is not provided within notice period.

  • The cancellation fee and the notice period will reflect the NDIS price guide in place at the time of the cancellation.

  • Service Provider may choose to end service agreement if repeat cancellations (3 or more) occur dependent on individual circumstance.

Payments

Reframe Careers will seek payment for their provision of services after the services have been delivered in accordance with the Clients NDIS Plan funding type noted below:

Payment is due by Electronic Funds Transfer within 14 days of invoicing.

Rights & Responsibilities

Reframe Careeers agrees to: 

  • Listen to you and learn about what you want and need and support you to make decisions and choices

  • Provide the best available services appropriate to your needs, including consulting with you on decisions about how suports are provided

  • Ensure staff are appropriately skilled and trained

  • Follow the Disability Service Standards in everything we do

  • Provide supports in a manner consistent with all relevant laws e.g. National Disability Insurance Scheme Act 2013 and rules, and the Australian Consumer Law

  • Obtain your consent before commencing support

  • Regularly review the provision of services with you

  • Work in collaboration with you to acheive your goals

  • Communicate openly and honestly with you

  • Be polite and friedly and treat you with respect all all times

  • Explain things clearly so you understand every step of the process

  • Include you in all decisions about your services

  • Listen to your feedback and act quickly upon any complaints your report to us

  • Store your information carefully and maintain your privacy

  • Inform you of our role in teaching and training students and to ask for your consent where it is proposed that a student be involved in your services

  • Support you to access to Interpreter and Language Supports and independent advocacy support if required


You agree to: 

  • Inform Reframe Careers of the services you want

  • Treat Reframe Careers staff with courtesy and respect

  • Notify Reframe Careers about any changes you wish to be made to this Service Agreement

  • Notfiy Reframe Careers if your NDIS plan changes (e.g. if you have a booked plan review)

  • Provide at least 24 hours notice if you wish to cancel a booked service

  • Provide at least 2 business days notice if you with to terminate our services.  You will be billed for the hours of service provided to the date of termination

  • Not make any recordings while services are being provided by Reframe Careers, unless express consent has been provided

  • Pay invoices by the due date

Your Safety

  1. Allow Reframe Careers, at the commencement of services, to work with you to identify any risks that may affect you, our staff or others, and to cooperate with all reasonable actions to minimise negative risk and enhance positive opportunities.

  2.  If you are NDIS funded and have Behaviour Support Funding, you agree to use that funding when 

    notified by Reframe Careers to reduce safety risks to you and others.

  3.  If services are being provided within your home,

    1. Allow 

      Reframe Careers prior to the commencement of the Service Agreement, to undertake ahome risk assessment to ensure that Workplace Health and Safety requirements are met, andyour home is a safe workplace for staff and other visitors.

    2. Inform 

      Reframe Careers if you have particular requirements regarding access to your home(e.g., key lock box, rear entrance).

    3. Take 

      reasonable steps to provide a safe environment, including not smoking, securing petsaway, and being free from the influence of non-prescription drugs and excessive alcohol whileservice is being provided to you.

    4. Take 

      reasonable steps to confirm your safety if you are not answering the door or phone fora scheduled visit; this may include trying other entrances to your property (if the services are being provided in your home), phoning your supported/substitutedecision maker/s or notifying the Police.

Your Safety

  1. Allow Reframe Careers, at the commencement of services, to work with you to identify any risks that may affect you, our staff or others, and to cooperate with all reasonable actions to minimise negative risk and enhance positive opportunities.

  2. If services are being provided within your home:

    1. Allow Reframe Careers prior to the commencement of the Terms & Conditions, to undertake a home risk assessment to ensure that Workplace Health and Safety requirements are met, and your home is a safe workplace for staff and other visitors. 

    2. Inform Reframe Careers if you have particular requirements regarding access to your home (e.g., key lock box, rear entrance).

    3. Take reasonable steps to provide a safe environment, including not smoking, securing pets away, and being free from the influence of non-prescription drugs and excessive alcohol while service is being provided to you.

    4. Take reasonable steps to confirm your safety if you are not answering the door or phone fora scheduled visit; this may include trying other entrances to your property (if the services are being provided in your home), phoning your supported/substitute decision maker/s or notifying the Police.

Intellectual Property

As between the parties, all intellectual property rights (including copyright) developed, adapted, modified or created by Reframe Careers or its team (including in connection with this Agreement or the provision of the services) will at all times vest, or remain vested, in Reframe Careers.

Limitation of Liability

Despite anything to the contrary, to the maximum extent permitted by law:

  1. you warrant that you have not relied upon any warranty, representation, statement, offer or document made or provided by or on behalf of Reframe Careers, whether before or after the commencement of this Agreement;

  2. you agree that this Agreement excludes all terms, conditions and warranties implied by statue, in face or on any other basis, except to the extent such terms, conditions and warranties are fully expressed in this Agreement;

  3. Reframe Carerrs' maximum aggregate liability arising from or in connection with this Agreement will be limited to, and will not exceed, the portion of the price paid by you to Reframe Careers for the services which are the subject of the relevant claim;

  4. Reframe Careers will have no liability, and you release and discharge Reframe Careers from all liability, arising from or in connection with any:

    1. event or circumstance beyond Reframe Careers reasonable control;

    2. acts or omissions of you, your guardians, friends and family;

    3. defect, error, omission or lack of suitability or benefit (or the absence of, or reduction in, any anticipated result, outcome or benefit) with respect to the services; and/or

    4. loss of profit (including anticipated profit), loss of benefit (including anticipated benefit), loss of revenue, loss of business, loss of goodwill, loss of opportunity, loss of savings (including anticipated savings), loss of reputation, loss of use and/or loss of corruption of data; and

  5. You will indemnify Reframe Careers for and against all liability arising from or in connection with any wrongful act or omission by you, your guardians, friends and family.

Your rights as a client

As a client, you have the following rights, which include:

  • The right to refuse any particular service

  • The right to terminate services at any time

  • The right to ask questions, access information and be informed about Services, and

  • The right to ask to be referred to a different team member if you feel we are not right for each other.

If you are dissatisfied with your Vocational Rehabilitation Counsellor’s services or conduct at any time or have any questions, please let them know or contact us directly at admin@reframecareers.com.au.

Cancellation Policy

  1. Give a minimum of 24 hours’ notice if you cannot make a scheduled appointment, unless an unexpected event prevents communication in which case notification will occur as soon as possible. Unless extenuating circumstances can be demonstrated, Reframe Careers’ Cancellation Policy may apply. 

  2. Reframe Careers will give you a minimum of 24 hours’ notice, wherever possible and within the limitations of unexpected staffing changes, if we must change a scheduled appointment to provide services.

  3. The cancellation fee is outlined in the ‘Schedule of Supports’. 

  4. Reframe Careers will try to reschedule services before any cancellation fees are charged. However repeated cancellations outside of the notice period will incur a cancellation fee that may not be covered by your funding provider and as such will be an out-of-pocket expense to you.

The NDIS allows for the Client's Plan to be charged for late cancellations / failure to attend by Clients.  If there are frequent cancellations, Reframe Careers will contact you to try to understand why they are occurring and see if anything needs to change in the delivery of Services to support the Client.  Clients must pay for any cancellation fees not covered by the NDIS.

Cancellation Policy

We understand there are sometimes valid reasons why you may need to cancel and reschedule an appointment. However, we ask that where possible, 24 hours’ notice be given for cancellation of all sessions. If less than 24 hours' notice is given, a cancellation fee of 50% will be charged. 

Refunds 

We have professional credentials and make every effort to meet and exceed client expectations; however, we do not offer refunds on any of our services

Outstanding Fees

Outstanding fees need to be paid prior to further services being provided.  If fees are not paid, Reframe Careers may contact the following (where applicable) to recover the outstanding debt:

  • Plan Manager

  • Support Coordinator

  • LAC/ECEI Partner

  • NDIA

  • Debt collector

  • The Client / Client's Representative will be liable for any outstanding debts that are not payable by the NDIA and also the costs associated in recovering such debts.

Goods & Services Tax (GST)

For the purposes of GST legislation, the Parties confirm that: 

  • A supply of supports under this Service Agreement is a supply of one or more of the reasonable and necessary supports specified in the statement included, under subsection 33 (2) of the National Disability Insurance Scheme Act (NDIS Act), in the Client's NDIS plan currently in effect under section 37 of the NDIS Act;

  • the Client's NDIS plan is expected to remain in effect during the period the supports are provided; and

  • the Client / Client's Authorised Representatice will immediately notify Reframe Careers if the Client's NDIS plan is replaced by a new plan, or if the Client stops being a client within the NDIS.

Your informed consent is cruical for us to use these technologies. Be assured that any personal information collected is handled with strict confidentiality and in full compliance with the Privacy Amendment (Enhancing Privacy Protection) Act 2012 and the Privacy Act 1988.

Everbility Privacy Details:

  • Everbility is in compliance with the Australian Privacy Principles, the Privacy Act and the Health Insurance Portability and Accountability Act (HIPAA) and General Data Protection Regulation (GDPR).

  • Everbility does not use your personal information for any purpose other than the primary purpose for which Reframe uses Everbility.

  • Your notes and report templates are encrypted at rest and in transit.

  • Everbility has an agreement with OpenAI wherein OpenAI does not use any data provided by Reframe to Everbility to train its AI models and the data is not stored on OpenAI servers at all. OpenAI is SOC2, SOC3 and GDPR compliant. You can learn more here: https://trust.openai.com/

  • Any information you provide directly to Everbility will not be visible, accessible or shared with any other Everbility subscriber, nor will they be imitated as answers to any other subscribers.

Making a Complaint

Reframe Careers encourages clients, families and others to provide feedback, and to raise concerns about any aspect of service delivery to your service delivery team.

You can give us feedback about the services you receive from us, including when you are not happy with the services you receive from us.

Changes to this Service Agreement

  1. If changes to your supports or their delivery are required, we both agree to discuss and review this Service Agreement.

  2. Changes to your supports requires a minimum of two weeks’ notice (see point 3A and 3B below).

  3. A change to your support needs may mean a change to how much we need to charge:
    A) This means that a review of your supports and funding approval will need to happen before services can be changed.
    B) You may need to request a review of your NDIS plan and Reframe Careers may need to provide a quote to the NDIA.

  4. You agree to let Reframe Careers know immediately if your funding is suspended or replaced by a new Funding Agreement.

  5. Changes to service will be reflected in the Schedule of Supports, to include the amount you/your funder will be charged, and this will be signed and dated.

  6. Reframe Careers can ask you to review this Service Agreement if you regularly change, cancel or do not attend your planned Service.

Ending this Service Agreement

  1. Reframe Careers may put services on hold if you have not paid/we are unable to claim for the services you already have received, within 14 days of receiving these.

  2. Reframe Careers will give you fair and reasonable notice if we need to end this Service Agreement for any reason.

  3. Your Service agreement will terminate automatically if:

    A)  Reframe Careers is de-registered as a funded provider for your funding agency.

    B)  You cease to be a participant/eligible for the Funding received by your provider.

  4. Serious breaches of this Service Agreement may result in immediate ending of this Service Agreement and the requirement of notice will be waived.

Disputes

Reframe Careers endeavours to maintain a positive relationship with you and your family/representative. Where there is a conflict, dispute or disagreement between Reframe Careers and your family/representative, Reframe Careers will first attempt to resolve the conflict informally with the aim to achieve a mutually acceptable outcome.

In circumstances, whereby conflict continues betweenReframe Careers and your family/representative the Complaints Team will become involved. First and foremost, Reframe Careers will ensure your rights and wellbeing is upheld.

Signatures

Implied Terms and Consumer Guarantees

  1. Subject to the below, and any condition or warranty, which would otherwise be implied in this agreement, is excluded.

  2. Reframe Careers liability for breach of a guarantee conferred by the Australian Consumer Law (other than those conferred by sections 51 to 53 of the Australian Consumer Law) is limited to:
    A) the supplying of the services again; or

    B) the payment of the cost of having the services supplied again.

Disclaimers

In signing this Agreement, you acknowledge and agree that:

  1. While Reframe Careers uses reasonable commercial endeavours to provide support, results may vary as each person is different.

  2. Your results will depend on your commitment to your support plan and any advice or instructions that have been given to you by Reframe Careers;

  3. Reframe Careers does not guarantee outcomes with respect to the results of its services, including any improvement in life and/ or social skills; and

  4. Reframe Careers does not provide medical advice. If you require any medical advice, it is recommended that you seek a medical professional.

Acknowledgment of Informed Consent

By signing below, you acknowledge and agree that you:

  • Understand your rights as a client and the confidentiality obligations and exceptions;

  • Give consent for Reframe to collaborate with your therapy team;

  • Consent for Reframe to collect your personal and sensitive information

  • Were provided with the opportunity to contact Reframe to discuss the contents and any questions about the Form; and

  • Are fully prepared to accept vocational services from Reframe.
